Copyright & Usage Policy
Initially, Australian Copyright Law, which is recognised Internationally, provides that an image does not need to carry the Copyright symbol, ©, for it to be protected under these laws. Copyright of an image is assumed unless it is proven otherwise. If you have arranged with Elizabeth Hawkes/ Capital Magazine Publishing Pty Ltd for the release of the ownership of these images, please disregard this, but a
condition of ANY assignment undertaken is that if a resultant image is published in any form whatsoever it must be accompanied by the acknowledgement, ‘image/s by Elizabeth Hawkes’.
Generally, and unless otherwise stated in writing prior to the commencement of an assignment, Elizabeth Hawkes’ fees for the production of photographic images, provide our client (or end client) with rights to use the images supplied for the original intended use and editorial purposes.
This entitlement or agreement cannot be on-sold, reassigned, lent or otherwise used by a third party without the written consent of Elizabeth Hawkes (where an Additional fee will be negotiated). Elizabeth Hawkes/ Capital Magazine Publishing Pty Ltd reserves the right to rescind all Client rights to usage and any entitlements within this agreement. Any entitlements will only be relinquished when the
Invoice has been paid in full.
Elizabeth Hawkes/ Capital Magazine Publishing Pty Ltd retains ownership of the copyright of the resultant images of an assignment, unless otherwise stated in writing. We are happy for our clients to own copyright; where a fee will be charged.
Elizabeth Hawkes reserves the right to use any image/s from any assignment undertaken for the purpose
of the promotion of her work or Capital Magazine Publishing Pty Ltd.
Although the client may have physical possession of the images, subsequent use of the image/s is subject to renegotiation of usage fees, in writing, for a use other than that originally intended.
By commissioning Elizabeth Hawkes to complete your proposed assignment, your business, company or you as its representative, acknowledge Copyright Law and agree to the above conditions. Elizabeth Hawkes/ Capital Magazine Publishing Pty Ltd reserves the right to pursue, legally, any breach of these requirements.

Please do not rely on CD’s or DVD’s as these items are not insured and cannot be replaced, so please note that you should immediately make a copy of the CD Rom/s and keep in a safe place. It is also recommended that the images be copied onto new disks every 4/5 years.
